Strategy First. Design Second.

The secret to the new development assessment process isn't that the rules have become easier. In fact, the bar for entry has been raised.

The Victorian Government has introduced a much more rigorous set of standards that must be met. This requires significantly more work upfront - more technical detail on our drawings and more specific information provided from the very first day.

Does this mean Council won't ask questions? Not necessarily. In fact, because the requirements are now more detailed, it is still common for Council to issue an RFI (Request for Further Information). However, there is a massive shift in why they are asking:

  • From "Subjective" to "Objective": In the past, delays were often caused by the personal opinions of council officers or neighbours. Today, the planning scheme is written so that if the technical standards are met, Council is to grant the permit.

  • Ticking the Boxes: An RFI is no longer a sign of a stalled project; it’s often a procedural step to ensure every new box is officially ticked.

  • Removing the Grey: Once we satisfy these specific, objective standards, the grey areas are removed. The discretion is gone, and the path to approval becomes a matter of compliance, not a matter of luck.

  • Bypassing VCAT Appeals: One of the biggest risks in property development has always been the frivolous neighbor appeal at VCAT. Under the new rules, if our design meets the objective standards, third-party appeal rights are significantly restricted. This means that once the standards are met, a neighbour’s personal opinion can no longer trigger a 12-month VCAT delay, giving you a clear, quicker path to your planning permit.
